1. Scope of Application

1.1 These General Terms and Conditions ("GTC") govern all services and legal transactions carried out through the online shop www.equinetree.com (the "Shop"), operated by Vassalli AG, a company registered in Switzerland ("Equinetree", "we", "us", or "our").

1.2 By placing an order through the Shop, you ("Customer", "you", or "your") acknowledge that you have read, understood, and agree to be bound by these GTC.

1.3 We reserve the right to modify these GTC at any time. The version applicable to your order is the version in effect at the time you place your order.

3. Products, Descriptions, and Pricing

3.1 Product Information

All product displays on the Shop constitute invitations to order and do not constitute binding offers. We strive to ensure that product descriptions, specifications, and images are accurate; however, we cannot guarantee complete accuracy as some information is provided by third parties.

3.2 Pricing and Value Added Tax (VAT)

3.2.1 All prices displayed on the Shop are shown inclusive of applicable Value Added Tax (VAT) where required by law. The applicable VAT rate depends on your shipping destination:

• a) Switzerland: Swiss VAT at 8.1% (UID: CHE-108.051.705) applies to all orders shipped to Swiss addresses from our Swiss warehouse.
• b) European Union: EU VAT at the applicable rate for the destination country (EU VAT ID: DE456585594) applies to orders shipped from our European warehouse to EU addresses. We are VAT-registered in the EU and charge the appropriate local VAT rate.
• c) Rest of World: Prices are shown excluding VAT/sales tax. You may be required to pay import VAT, customs duties, and other charges upon delivery as determined by your local customs authorities (see Section 7).

3.2.2 The Shop automatically detects your location and displays prices in your local currency (Swiss Francs, Euros, or US Dollars) for convenience. Currency conversion is based on current exchange rates.

3.2.3 The exact amount charged, including applicable VAT and any currency conversion fees, will be clearly displayed at checkout before you complete your order.

3.2.4 All quoted prices are binding at the time of order placement but may change without notice for future orders.

3.3 Product Availability

Product availability and inventory levels may change without notice. If an ordered item becomes unavailable after order placement, we will notify you promptly and offer alternatives or a full refund.

4. Ordering Process

4.1 When you place an order through the Shop, you are making an offer to purchase the selected products under these GTC.

4.2 Upon receiving your order, you will receive an automatic confirmation email acknowledging receipt. This confirmation does not constitute acceptance of your offer.

4.3 The contract between you and Equinetree is concluded only when we send you a dispatch confirmation email confirming that your order has been processed and is ready for shipment.

4.4 We reserve the right to refuse any order at our discretion, including but not limited to cases of suspected fraud, incorrect pricing, or product unavailability.

5. Payment

5.1 Accepted Payment Methods

Payment can be made using the following methods:

• TWINT (for Swiss customers)

• Apple Pay

5.2 Payment Processing

5.2.1 Payment is debited immediately upon order placement.

5.2.2 Purchase on account (invoice) is not currently available.

5.2.3 Your payment information is processed securely through our certified payment service providers. We do not store complete credit card information on our servers.

5.3 Currency and Exchange Rates

If you pay in a currency different from your card's billing currency, your card issuer may apply additional foreign exchange fees. Equinetree is not responsible for such fees.

6. Shipping, Delivery, and Fulfillment

6.1 Fulfillment Centers and Shipping Origins

Equinetree operates two fulfillment centers to serve customers efficiently:

Swiss Warehouse: Vassalli AG, Im Langstuck 21, CH-8044 Gockhausen, Switzerland

European Warehouse: Equinetree, Albführen 1, 79802 Dettighofen, Germany

Orders are fulfilled from the most appropriate warehouse based on your delivery address:

• Orders to Switzerland are shipped from our Swiss warehouse
• Orders to EU countries and rest of world are shipped from our European warehouse in Germany

6.2 Shipping Methods and Carriers

6.2.1 Switzerland: Swiss Post A-Post (Priority Mail) from our Swiss warehouse

6.2.2 European Union: DHL, DPD, or equivalent carriers from our European warehouse

6.2.3 Rest of World: DHL Express, FedEx, or other international carriers from our European warehouse

6.3 Delivery Times

6.3.1 Switzerland: 1-3 working days for in-stock items

6.3.2 European Union: 3-7 working days

6.3.3 Rest of World: 7-21 working days depending on destination and customs processing

6.3.4 Delivery times are estimates only and may vary due to factors beyond our control, including customs clearance, weather conditions, or carrier delays.

6.4 Shipping Costs

Shipping costs vary based on destination, package weight, and shipping method. All shipping costs will be clearly displayed at checkout before you complete your order. Shipping costs are subject to the same VAT treatment as the products ordered.

6.5 Risk Transfer

Risk of loss or damage to products passes to you upon dispatch from our warehouse. We recommend that international customers consider purchasing shipping insurance if available.

6.6 Failed Delivery

If a delivery cannot be completed due to incorrect address information provided by you, or if you refuse delivery, you will be responsible for return shipping costs. Refunds will be processed minus actual shipping and return costs incurred.

7. Customs, Duties, and Import Taxes

7.1 Switzerland Customers

Orders to Switzerland are shipped from our Swiss warehouse and include Swiss VAT (8.1%) in the displayed price. No additional customs duties or import taxes apply.

7.2 European Union Customers

Orders to EU countries are shipped from our EU warehouse in Germany and include the applicable EU VAT for your country in the displayed price. No additional customs duties apply for intra-EU shipments.

7.3 International Customers (Outside EU and Switzerland)

7.3.1 For shipments outside Switzerland and the European Union, you (the Customer) are the importer of record and are responsible for all import duties, customs fees, taxes (including VAT/GST), and any other charges imposed by your country's customs authorities.

7.3.2 These fees are determined by your local customs authorities and are beyond our control. We cannot predict the exact amount of these fees.

7.3.3 Prices displayed on our website for international destinations are exclusive of import duties and taxes. You will be required to pay these fees to the carrier or customs authorities upon or before delivery.

7.3.4 Equinetree is not responsible for any delays caused by customs clearance processes.

7.3.5 If you refuse to pay required customs fees, duties, or taxes, resulting in the package being returned to us, you will be responsible for all shipping costs (both ways) and any customs fees incurred. Refunds will be processed minus these costs.

7.3.6 We declare the actual value of goods on all customs forms and cannot mark items as 'gifts' or undervalue products.

8. Right of Withdrawal and Returns

8.1 Return Period

You have the right to return products within 30 days of receipt, provided the conditions in Section 8.2 are met.

8.2 Return Conditions

To be eligible for a return, products must:

• Be unused and in the same condition as received
• Be in original packaging with all tags and labels intact
• Include proof of purchase (receipt or order confirmation)
• Not be personalized, customized, or made-to-order items

8.3 Return Process

8.4 Return Shipping Costs

8.4.1 Customers are responsible for return shipping costs unless the product is defective or we made an error in your order.

8.4.2 We recommend using a trackable shipping service for returns. Equinetree is not responsible for lost return shipments.

8.5 Refunds

8.5.1 Once we receive and inspect your returned item(s), we will process your refund within 14 business days.

8.5.2 Refunds will be issued to the original payment method used for the purchase, including any VAT paid.

8.5.3 Original shipping costs are non-refundable unless the return is due to our error or a defective product.

8.6 Exchanges

We do not offer direct exchanges. If you wish to exchange an item, please return it for a refund and place a new order.

9. Warranty and Defects

9.1 All products are covered by a warranty against manufacturing defects under normal use conditions. The warranty period is governed by applicable law in your jurisdiction (minimum 2 years in the EU, 1 year in Switzerland for consumers).

9.2 Visible damage or defects must be reported immediately upon delivery, preferably documented with the delivery person and communicated to us within 48 hours at [email protected].

9.3 At our discretion, we will repair, replace, or refund defective products.

10. Liability

10.1 Equinetree's liability for any damage, loss, or injury arising from the use of our products or services is limited to the maximum extent permitted by applicable law.

10.2 We are liable for damages caused by intentional acts or gross negligence on our part or our representatives.

10.3 Nothing in these GTC excludes or limits liability that cannot be excluded or limited under applicable law, including liability for injury to life, body, or health, or liability under mandatory consumer protection laws.

11. Intellectual Property

All content on the Shop, including but not limited to text, graphics, logos, images, and software, is the property of Equinetree or its content suppliers and is protected by Swiss and international intellectual property laws.

12. Data Protection and Privacy

We collect, process, and use your personal data in accordance with our Privacy Policy and applicable data protection laws, including the Swiss Federal Act on Data Protection (FADP) and the EU General Data Protection Regulation (GDPR) where applicable. 13. Jurisdiction-Specific Provisions

13.1 European Union Customers

13.1.1 EU customers have a statutory right of withdrawal of 14 days from receipt of goods, in addition to our 30-day return policy.

13.1.2 EU consumers retain all rights under EU consumer protection directives and regulations. The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/.

13.2 United States Customers

U.S. customers retain all rights under applicable federal and state consumer protection laws.

13.3 Other Jurisdictions

Customers in other jurisdictions retain all rights under their local consumer protection laws.

14. Governing Law and Dispute Resolution

14.1 These GTC shall be governed by the substantive laws of Switzerland, excluding conflict of laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

14.2 Nothing in this section limits your rights as a consumer under mandatory local consumer protection laws in your jurisdiction.

14.3 For Swiss customers: Exclusive jurisdiction is Zurich, Switzerland. For international customers: Disputes may be brought either in Zurich, Switzerland, or in your local jurisdiction at your option.

15. Force Majeure

Equinetree shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, pandemics, strikes, or shortages of transportation facilities.

16. General Provisions

16.1 These GTC, together with our Privacy Policy, constitute the entire agreement between you and Equinetree.

16.2 If any provision is found invalid, the remaining provisions continue in full force.
